Terms of Service

1. Acceptance of Terms & Platform Nature

By accessing or using DMCart ("DMCart", "we", "our", or "us") through our website (dmcart.shop) or associated services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

Intermediary Status:DMCart functions as an IT intermediary platform (governed under Section 79 of the Information Technology Act, 2000, and the Consumer Protection E-Commerce Rules, 2020). We provide software and technological infrastructure enabling independent merchants ("Sellers") to create custom storefronts and sell products directly to end customers ("Buyers").

2. Merchant Accounts & Responsibilities

Sellers utilizing DMCart to create a store are solely responsible for all activities conducted under their account. You agree to:

  • Provide accurate, current, and genuine registration information.
  • Maintain clear, truthful listings of your products, including explicit pricing, descriptions, and fulfillment terms.
  • Verify your UPI ID or designated settlement credentials prior to publishing your store.
  • Independently handle all customer inquiries, order deliveries, tax compliance, and after-sales service regarding your specific items.

3. Direct UPI Payments & Future Premium Plans

Zero-Fee Direct Settlements:To support early merchant growth, DMCart offers direct UPI payment integrations. In this structure, Buyers pay Sellers directly into the Seller's personal/business UPI account. DMCart does not collect, hold, aggregate, or touch funds transferred via direct UPI, nor do we deduct commission fees on these direct transfers.

Pro Plans:DMCart may offer optional premium features ("Pro Plan") billed via subscription through verified payment gateways (e.g., Razorpay). Pro Plan subscription charges are billed in advance and governed by our Cancellation & Refund Policy.

4. Prohibited Uses & Restricted Items

Sellers are strictly forbidden from utilizing DMCart to sell, advertise, or promote any of the following restricted items:

  • Illegal drugs, regulated pharmaceuticals, or intoxicating substances.
  • Pirated software, copyright-infringing digital files, or counterfeit goods.
  • Unlicensed gambling, lottery tickets, betting applications, or fraudulent get-rich-quick schemes.
  • Weapons, hazardous materials, explosives, or items posing safety risks.
  • Adult content, sexually explicit digital goods, or material that violates local decency regulations.

Violation of these rules will result in immediate store suspension without prior notice and forfeiture of any active Pro plan subscriptions.

5. Limitation of Liability & Dispute Resolution

Because DMCart acts strictly as a technological enablement tool, we are not a party to the actual sales contract entered into between Buyers and Sellers.

DMCart shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from lost profits, undelivered goods, merchant misrepresentations, or payment network failures. Any transaction disputes must be resolved directly between the Buyer and the Seller.

These Terms shall be governed by and construed in accordance with the laws of India. Any jurisdictional disputes shall be subject to the exclusive jurisdiction of the competent courts.
